1. Services

Zenhomez provides premium home services — including painting, deep cleaning, waterproofing, and pest control — delivered exclusively through our in-house technicians. Service scope, pricing, and timelines will be confirmed via a quote/estimate prior to commencement of work.

2. Booking and Payment

• Bookings may be made through the Site, phone, WhatsApp, or authorised Zenhomez representatives.
• Prices quoted are based on the site assessment/information provided by the Customer; final pricing may vary if actual site conditions differ materially from what was disclosed.
• Payment terms (advance/milestone/full payment) will be specified in the quote. Delayed payments may result in suspension of work.
• All applicable taxes (e.g., GST) are additional unless stated otherwise.

3. Customer Responsibilities

• Provide accurate site information and access for inspection and execution of work.
• Disclose any known structural, electrical, or safety hazards at the property.
• Ensure the site is reasonably accessible on the scheduled date(s); rescheduling due to inaccessible sites may attract additional charges.

4. Warranty

Zenhomez provides a workmanship warranty of two years from the date of completion for the specific service performed, covering defects arising from faulty workmanship under normal use.

The warranty does not cover: damage from misuse, natural wear and tear, structural issues unrelated to the service performed, third-party interference, force majeure events, or pre-existing conditions not disclosed at the time of service.

Materials/products used (paints, waterproofing compounds, pest-control chemicals, etc.) carry the respective manufacturer's warranty, where applicable, and are not separately warranted by Zenhomez beyond correct application.

To claim warranty service, the Customer must notify Zenhomez in writing within the warranty period, and allow reasonable access for inspection and rectification.

5. Limitation of Liability

To the maximum extent permitted under applicable law:

• Zenhomez's total liability arising out of or relating to the Services, whether in contract, tort, or otherwise, shall not exceed the amount paid by the Customer for the specific service giving rise to the claim.
• Zenhomez shall not be liable for any indirect, incidental, consequential, or special damages, including loss of use, loss of data, or loss of profits.
• Nothing in these Terms excludes liability that cannot be excluded under applicable Indian law.

6. Cancellations and Refunds

• Cancellation requests must be made at least 24 hours before the scheduled service date to be eligible for a refund of any advance paid, less any costs already incurred by Zenhomez (e.g., material procurement).
• No-shows or last-minute cancellations by the Customer may forfeit the advance in part or full, at Zenhomez's discretion.
• Zenhomez reserves the right to cancel or reschedule a booking due to technician unavailability, safety concerns, or force majeure, in which case a full refund of any amount paid for the cancelled service will be issued.

7. Intellectual Property

All content on the Site, including text, logos, images, and the "Zenhomez" name and marks, is the property of Zenhomez Renovations LLP and may not be used without prior written consent.

8. Indemnity

The Customer agrees to indemnify and hold Zenhomez, its partners, employees, and technicians harmless from any claims, losses, or damages arising from inaccurate information provided by the Customer, undisclosed site hazards, or breach of these Terms.

9. Force Majeure

Zenhomez shall not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control, including natural disasters, strikes, government restrictions, or supply chain disruptions.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

11. Dispute Resolution and Arbitration

Negotiation first: In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the Services, warranty, or any breach thereof (a "Dispute"), the parties shall first attempt to resolve it amicably through good-faith negotiation within 30 days of written notice of the Dispute.

Arbitration: If the Dispute is not resolved through negotiation, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (including any statutory modification or re-enactment thereof), and the rules made thereunder.

• The arbitration shall be conducted by a sole arbitrator, mutually appointed by the parties. If the parties cannot agree on an arbitrator within 30 days of one party invoking arbitration, the arbitrator shall be appointed in accordance with the Act.
• The seat and venue of arbitration shall be Bengaluru, Karnataka, India.
• The language of arbitration shall be English.
• The arbitral award shall be final and binding on both parties, subject to the provisions of the Act.
• Each party shall bear its own costs of arbitration unless the arbitrator directs otherwise.

Interim relief: Nothing in this clause shall prevent either party from seeking interim or urgent relief from a competent court, where necessary, without waiving the right to arbitration.

Exclusive jurisdiction (subject to arbitration): Subject to the arbitration clause above, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any matters not subject to, or arising from, the arbitration (including enforcement of the award).

12. Amendments

Zenhomez may revise these Terms from time to time. Updated Terms will be posted on the Site with a revised "Last updated" date, and continued use of the Services after such changes constitutes acceptance.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
